We’d be interested in hearing from any locals who’ve been allegedly caught by the red light traffic camera on the A13 London Road, Leigh-on-Sea, between The Elms and Waitrose.
For those you’ve never been “got” by an Essex Police traffic light camera, here is the wording of the letter that gets sent to those who cross the line
INTENTION TO PROSECUTE
Location: A13 LONDON ROAD, JW CRANLEIGH DRIVE, LEIGH-ON-SEA
Offence: DRIVE ON ROAD OTHER THAN MOTORWAY, FAIL COMPLY WITH RED / GREEN ARROW / LANE CLOSURE LIGHT SIGNALS- AUTOMATIC EQUIPMENT
Contrary to: CONTRARY TO SECTION 36(1) OF THE ROAD TRAFFIC ACT 1988, THE TRAFFIC SIGNS REGULATIONS AND ROAD TRAFFIC ACT 1988, THE TRAFFIC SIGNS REGULATIONS AND GENERAL DIRECTIONS 2016 AND SCHEDULE 2 TO THE ROAD TRAFFIC OFFENDERS ACT 1988

Regardless as to whether you have any knowledge of this offence you are required to identify the driver of the vehicle on the above occasion or to supply any other information, which is in your power to give, and which may lead to his or her identification

What happens next?
Based on the experience of one of our team in October 2021, if the camera snaps you over the white stop line when the light is red, you’ll get a NIP (Notice of Intention to Prosecute) through the post, typically within 14 days of the alleged incident. You have to respond by stating who was driving. In our case, the next step was a follow-up letter with 3 choices:
- Attend a driver educational course (3 hours, £90)
- Pay a £100 fine and get 3 points on the licence
- Challenge the matter through the Magistrate’s Court
Getting the evidence
Essex Police appear not to make this easy. We understand that the camera in question takes two photos (one second apart) to confirm movement, but the letter from Essex Police’s Road Policing Support Team states on the subject of getting photos: “There is no requirement and therefore the Police do not supply any documentation at this stage. Such evidence will only be provided in the event of the matter being progressed to court”
